1. Acceptance of Terms

By downloading or using Birthday Messenger, you agree to these Terms of Service. If you do not agree, please do not use the app.

2. Description of Service

Birthday Messenger is a mobile application that helps users remember and send birthday messages to their contacts using AI-generated personalized messages.

3. User Accounts

You must create an account to use Birthday Messenger. You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. In-App Purchases

Birthday Messenger offers consumable in-app purchases ("message credits") that allow you to generate AI-written birthday messages. Credits are sold in fixed packs through Apple's App Store and processed by Apple, not by us. We never see your payment information.

Pricing & Validity

• Each new account receives 3 free welcome credits, valid for 30 days from signup.
• Paid credit packs are valid for 365 days from purchase.
• Each generated message consumes 1 credit. Credits are consumed in order of nearest expiration first.
• Unused credits expire silently — no refunds for expiration. We may notify you before expiration as a courtesy.

Refunds

All in-app purchases are processed by Apple. Refund requests must be submitted to Apple via reportaproblem.apple.com. We have no ability to grant or deny refunds directly.

If Apple approves a refund, the corresponding credit pack is removed from your Birthly account. Credits already consumed before the refund are not reversible — usage history is preserved for support purposes only.

Restore Purchases

Tapping "Restore Purchases" recovers any unconsumed paid credits associated with your Apple ID. Apple does not retain consumable receipts beyond approximately 30 days, so older fully-consumed purchases cannot be restored — this is a limitation of Apple's StoreKit, not Birthday Messenger.

Subscriptions

Birthday Messenger does not offer subscriptions. All purchases are one-time consumable packs.

5. User Data

You retain ownership of all contacts and messages you add to Birthday Messenger. We store your data securely to provide the service. You can delete your data at any time from the app settings.

6. Acceptable Use

You agree not to use Birthday Messenger to send spam, harass others, or engage in any illegal activity. We reserve the right to suspend accounts that violate these terms.

7. AI-Generated Content

Birthday Messenger uses AI to generate birthday message suggestions. These suggestions are for personal use only. We do not guarantee the accuracy or appropriateness of AI-generated content.

8. Privacy

Your use of Birthday Messenger is also governed by our Privacy Policy.

9. Disclaimers

Birthday Messenger is provided "as is" without warranties of any kind. We are not responsible for any missed birthdays or failed message deliveries.

10. Limitation of Liability

To the maximum extent permitted by law, Birthday Messenger shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any significant changes via the app or email.
